Terms of Service
DEFINITIONS
“Booking” means a reservation made by a Customer through the Lugate Platform for one or more Services to be provided by a Partner or, where applicable, by Lugate.
“Lugate” refers to Lugate (“Lugate”, “we”, “us”, or “our”), the provider of the Lugate Platform.
“Lugate Platform” means Lugate’s websites, mobile applications, and any affiliated digital platforms through which Customers can search, reserve, and pay for storage Services and through which Partners can manage their bookings.
“Customer” refers to any individual who purchases or intends to purchase storage or related Services through the Lugate Platform.
“Customer Property” or “Property” means any personal belongings, luggage, or items owned or controlled by a Customer that are temporarily stored, transferred, or handled in connection with the Services. Any reference to “Items” in these Terms refers to Customer Property.
“Partner” or “Partner Location” means a business, shop, hotel, or other physical location that collaborates with Lugate to provide luggage storage space to Customers.
“Prohibited Items” means any items that are restricted or forbidden under these Terms of Service or under applicable laws or Lugate policies.
“Services” means the temporary and secure storage of bags, luggage, or personal belongings provided by Partner Locations and facilitated through the Lugate Platform.
1. OUR ROLE
1.1 Platform Provider
Lugate operates an online platform that enables Customers who wish to temporarily store their luggage or personal belongings to locate and reserve storage space at Partner Locations. These Partner Locations may include retail stores, hotels, cafés, or other commercial establishments offering short-term storage services.
1.2 Services Facilitated by Lugate
The Lugate Platform connects Customers with Partner Locations offering the following services:
1.2.1 Storage Service
Customers can search for and book short-term storage space for their Customer Property at Partner Locations.
1.2.2 Delivery Service
Where available, Customers may request delivery of Customer Property between Partner Locations, their accommodation, or other designated locations. Delivery services may be subject to separate terms and conditions presented on the Lugate Platform.
1.2.3 Additional Services
From time to time, Lugate may enable additional services through the Platform. Any such services will be governed by the applicable terms communicated through the Lugate Platform.
1.3 Scope of These Terms
These Terms of Service apply only to bookings and services arranged through the Lugate Platform and where the interaction between Customers and Partner Locations takes place through the Platform.
1.4 Services Outside the Platform
Any products or services obtained directly from Partner Locations outside the Lugate Platform are not governed by these Terms and may be subject to separate pricing and conditions determined by the Partner Location.
1.5 Relationship with Partner Locations
Lugate does not own, operate, or manage Partner Locations unless explicitly stated. Lugate acts only as a facilitator that connects Customers with Partner Locations and is not a party to the direct service agreement between Customers and those locations.
2. ACCOUNT REGISTRATION
2.1 Account Requirement
Certain features of the Lugate Platform require the creation of a user account. Users must be at least eighteen (18) years old to register and use the Services.
2.2 User Representations
By creating an account and using the Lugate Platform, you confirm that:
· You are at least 18 years old
· You have the legal capacity to enter binding agreements
· The information provided during registration is accurate and complete
· You have not previously been suspended or prohibited from using the platform
· Your use of the platform complies with all applicable laws and regulations
2.3 Account Information
When registering, you may be asked to provide information such as your name, email address, phone number, and payment details.
2.4 Account Security
You are responsible for maintaining the confidentiality of your login credentials and all activities conducted through your account. If you believe your account has been compromised, you must notify Lugate immediately at support@lugate.com.
2.5 Acceptance of Terms
By creating an account, registering, or signing up for the Lugate mobile application or website, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. The act of signing up for a Lugate account constitutes acceptance of these Terms and forms a binding agreement between you and Lugate regarding the use of the Lugate Platform and Services.
3. PROHIBITED ITEMS
3.1 Restricted Items
Customers may not store, transport, or handle the following items through the Lugate Platform:
· Items illegal under applicable laws
· Weapons, firearms, ammunition, or explosives
· Flammable or hazardous materials
· Toxic chemicals or pesticides
· Live animals or plants
· Perishable food items
· Alcoholic beverages or illegal drugs
· Cash, securities, or negotiable financial instruments
· Jewelry, precious metals, and gemstones
· Valuable collectibles such as antiques or artwork
· Official documents such as passports or immigration papers
· Medical drugs or medical devices
· Pornographic or offensive materials
· Waste or hazardous materials
· Political or extremist materials
· Electronic devices containing sensitive or high-value information
3.2 Inspection Rights
Lugate and Partner Locations reserve the right to inspect Customer Property in the Customer’s presence to ensure compliance with these Terms. Any item deemed unsafe or prohibited may be rejected.
3.3 Law Enforcement
If a stored item is suspected to violate applicable laws, Lugate or the Partner Location may notify law enforcement authorities.
3.4 Liability for Prohibited Items
Lugate does not assume any responsibility for loss, damage, or theft of Prohibited Items.
4. PAYMENTS
4.1 Service Fees
Customers may be required to pay applicable fees to use the Services. All charges will be displayed on the Lugate Platform before a booking is confirmed.
4.2 Payment Processing
Payments may be processed through secure third-party payment providers such as Stripe, PayPal, Apple Pay, or other authorized payment systems.
4.3 Payments Outside the Platform
Customers should not make payments directly to Partner Locations outside the Lugate Platform unless explicitly authorized.
4.4 Service Charges
Lugate may charge a service fee for each booking. This fee may include access to customer support and applicable service protections offered through the platform.
4.5 Price Changes
Lugate reserves the right to modify pricing from time to time. Any changes will apply only to future bookings.
4.6 Promotions
Lugate may offer promotional pricing, discounts, or credits under specific terms communicated through the platform.
4.7 Unpaid Fees
Lugate may suspend or terminate accounts with outstanding unpaid balances.
5. BAG PROTECTION
5.1 Protection Coverage
Lugate may offer limited protection for lost, stolen, or damaged Customer Property during the storage period.
5.2 Coverage Scope
Protection applies only to items linked to a valid booking made through the Lugate Platform.
5.3 Compensation Limit
If applicable, Lugate may compensate Customers up to a specified maximum value per booking. The amount will depend on the circumstances and supporting evidence provided.
5.4 Exclusions
Bag Protection does not apply to:
· Prohibited Items
· Items stored outside the Lugate Platform
· Improperly packed or fragile items
· Abandoned items not collected within the booking period
5.5 Claims Process
To submit a claim, Customers must:
· Provide proof of booking and payment
· Notify Lugate within 24 hours after the booking ends
· Provide supporting evidence such as photos, receipts, or reports
6. REVIEWS
After completing a booking, Customers may submit reviews regarding Partner Locations and the Services received. Reviews must be truthful, respectful, and free from offensive or defamatory language.
7. STORAGE SERVICES
7.1 Booking Requirements
Customers must make a booking through the Lugate Platform and follow the instructions provided during the check-in process.
7.2 Storage Period
Customer Property will be stored for the duration specified in the booking. Customers must collect their items before the booking period ends.
7.3 Unclaimed Items
If items are not collected within the agreed storage period, additional charges may apply. If the Customer cannot be contacted, the Partner Location may dispose of the items in accordance with applicable laws.
7.4 Cancellation Policy
Customers may cancel bookings subject to the following conditions:
· Cancellations made well before the scheduled drop-off time may qualify for a full refund.
· Late cancellations may be refunded as Lugate credits for future use.
7.5 Customer Declaration at Partner Location
Customers may be required to complete and sign a declaration form at the Partner Location when dropping off their bags or luggage. By signing this declaration, the Customer confirms that the stored items do not contain any Prohibited Items as defined in these Terms of Service and that the contents comply with all applicable laws and Lugate policies. Lugate and Partner Locations reserve the right to refuse storage services if a Customer declines to sign the declaration form when requested.
8. LICENSES
8.1 Platform License
Subject to compliance with these Terms, Lugate grants users a limited, non-exclusive, and non-transferable license to access and use the Lugate Platform for personal purposes.
8.2 Restrictions
Users may not copy, modify, distribute, reverse engineer, or exploit the Lugate Platform or its content without written permission.
8.3 Data Collection Prohibition
Users are not permitted to collect or scrape information about Partner Locations, customers, or platform data for commercial use.
8.4 Feedback
Any suggestions or feedback submitted to Lugate may be used by Lugate to improve the platform without obligation or compensation.
9. CONTENT
9.1 User Content
Users may upload content such as reviews, photos, messages, or other materials to the Lugate Platform.
9.2 License to Use Content
By submitting content, users grant Lugate a worldwide, royalty-free license to use, display, and distribute that content for platform operations and promotional purposes.
9.3 Responsibility for Content
Users are solely responsible for the content they submit and must ensure it does not violate any laws or third-party rights.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Lugate and Partner Locations shall not be liable for indirect, incidental, or consequential damages arising from the use of the Lugate Platform or Services. The total liability of Lugate for any claim related to the Services will not exceed the amount paid by the Customer for the relevant booking.
11. INDEMNIFICATION
Users agree to indemnify and hold Lugate, its affiliates, and Partner Locations harmless from any claims, damages, or expenses arising from:
· Violation of these Terms
· Misuse of the Lugate Platform
· Violation of applicable laws or third-party rights
